2. Definitions
The Seller is MediaBrothers, s. r. o.
The Buyer is a person who orders goods through the online shop.
The Consumer is a natural person who, when entering into and performing a contract, is not acting within the scope of their business activity, employment or profession.
Goods means products offered through the online shop, in particular art prints, posters, clothing and other products.
The Online Shop means the online store operated on the website simicekovska.com.
3. Goods and Their Characteristics
The Online Shop may offer, in particular:
- limited-edition art prints
- posters
- clothing
- other products featuring motifs from works by Simi Čekovská
Limited-edition prints are numbered, signed by the artist and supplied with a certificate. The prints are delivered unframed, securely packaged in their original tube.
Product photographs are intended to represent the appearance of the products as accurately as possible. However, colours may vary slightly depending on monitor settings, display type or the method of display.
For products from limited collections, availability may be restricted. If, for technical or stock-related reasons, it is not possible to supply an ordered product, the Seller will inform the Buyer without undue delay and refund the payment received, or agree with the Buyer on an alternative solution.
Limited-edition prints cannot be automatically restocked once sold out. If a product sells out, the Seller does not guarantee that it will become available again.
4. Orders and Conclusion of the Purchase Contract
The Buyer orders goods by adding the selected product to the shopping cart and submitting the order through the Online Shop.
Before submitting the order, the Buyer has the opportunity to review the contents of the shopping cart, the price of the goods, shipping costs, billing and delivery details, and the payment method.
By submitting the order, the Buyer confirms that they have read and understood these Terms and Conditions, the Instructions on Withdrawal from the Contract, the Complaints Procedure and the Personal Data Processing Policy.
The order is submitted with an obligation to pay.
The purchase contract is concluded when the Seller confirms the order, usually by e-mail sent to the address provided by the Buyer in the order.
The Seller reserves the right to reject or cancel an order, in particular in the event of:
- unavailability of the goods
- an obvious error in the price or product description
- a technical error in the Online Shop
- inability to deliver to the selected country
- suspicion of a fraudulent or abusive order
If the order has already been paid for and the Seller is unable to fulfil it, the payment received will be refunded to the Buyer.
5. Prices and Payment Terms
Prices in the Online Shop are stated in EUR and include VAT.
Shipping costs are stated separately during the ordering process before the order is submitted.
The Buyer may pay for the goods using the payment methods available in the Online Shop. As a standard method, this primarily includes payment by card or other online payment methods provided by the GoPay payment gateway.
Bank transfer or payment by invoice is used primarily for individual sales of original works of art or in the case of individual customer requests, if separately agreed between the Seller and the customer.
The Seller will issue the Buyer with a tax document or invoice in accordance with applicable law.
6. Delivery of Goods
The Seller delivers goods within Slovakia, to the Czech Republic, to countries of the European Union and to selected countries outside the European Union.
Available delivery destinations, shipping methods and shipping costs will be displayed during the ordering process.
The Seller normally dispatches orders within 3–5 business days of receiving payment, unless otherwise stated for a particular product.
For deliveries outside the European Union, customs duties, taxes, import charges or other local fees may apply. Unless expressly stated otherwise, these charges are not included in the price of the goods or shipping costs and are borne by the Buyer.
The Buyer is required to inspect the shipment upon receipt. If the packaging is damaged, we recommend accepting the shipment with reservations, documenting the damage with photographs and contacting us without undue delay at: info@simicekovska.com.
7. Withdrawal from the Contract
A Buyer who is a Consumer has the right to withdraw from the contract without giving any reason within 14 days of receiving the goods.
Detailed information on the right of withdrawal and the model withdrawal form are provided in the separate document “Instructions on Withdrawal from the Contract.”
Where the Buyer withdraws from the contract for reasons unrelated to a defect in the product, the Buyer bears the direct costs of returning the goods.
Returned goods must be undamaged, clean, unused beyond what is necessary to determine their nature and characteristics, and securely packaged. In the case of prints, we recommend using the original tube or another secure method of packaging to prevent damage during transport.
The Seller may withhold the refund until the returned goods have been received or until the Buyer provides evidence that the goods have been sent back.
8. Exchanges of Clothing Sizes
For clothing, the standard 14-day right of withdrawal may be exercised.
Exchanges for a different size are not guaranteed. Since some products may form part of limited collections, another size may not be available in stock.
If the Buyer is interested in a different size, we recommend contacting us first at info@simicekovska.com. If the requested size is available, we will try to find a practical solution.
9. Complaints and Liability for Defects
The Seller is liable for defects in the goods to the extent prescribed by applicable law.
The Buyer may submit a complaint by e-mail to info@simicekovska.com or by sending the goods to:
MediaBrothers, s. r. o., Office 142, Vajnorská 142, 831 04 Bratislava
Details regarding the submission and handling of complaints are set out in the separate Complaints Procedure.

13. Alternative Dispute Resolution for Consumer Disputes
If the Consumer is not satisfied with the manner in which their request, complaint or grievance has been handled, they may contact the Seller with a request for remedy at: info@simicekovska.com.
If the Seller rejects the request or fails to respond within the statutory time limit, the Consumer has the right to submit a proposal for the initiation of alternative dispute resolution proceedings.
The competent alternative dispute resolution entity for consumer disputes is, in particular, the Slovak Trade Inspection, or another authorised entity included in the list of alternative dispute resolution entities maintained by the Ministry of Economy of the Slovak Republic.
14. Final Provisions
These Terms and Conditions are governed by the laws of the Slovak Republic.
If any provision of these Terms and Conditions becomes invalid or ineffective, this shall not affect the validity of the remaining provisions.
The Seller reserves the right to amend or supplement these Terms and Conditions. The Terms and Conditions in force at the time the Buyer submits the order shall apply to that order.
These Terms and Conditions shall enter into force on 1 July 2026.
